If you are entering into this agreement on behalf of a company or other legal entity, you represent that you have the authority to bind such entity and its affiliates to these terms and conditions. If you do not have such authority or if you do not agree with the terms and conditions of this agreement, do not use this service or its output, and you must not accept this agreement.

This agreement shall apply only to the services supplied by Truss Pal herewith regardless of whether other services or software are referred to or described herein. The terms also apply to any Truss Pal supplements or support services unless other terms accompany those items on delivery. If so, those terms apply.

Results from any engineering software should always be double-checked when applied in real-life applications. As a Truss Pal user, it is your responsibility to verify and validate the output of the software with some other independent means. As a user of Truss Pal, particularly professional engineers, you agree to use sufficient duty of care when using Truss Pal’s products. This includes not designing or constructing anything outside of your abilities and knowledge as an engineer. One should always question the results and perform sufficient checks that the results are logical and correct. Truss Pal takes no responsibility for any damages, liabilities, or consequences resulting from any use of our website or Truss Design Drawings.

A party shall not be liable for any failure of or delay in the performance of this agreement for the period that such failure or delay is due to causes beyond its reasonable control, including but not limited to acts of God, war, strikes, or labor disputes, embargoes, government orders or any other force major event.

The forces, materials, and results are all based on theoretical input and solutions. With any structure or design, a wide variety of other factors can directly impact the actual results and behavior of said structures. Some examples include other loads (e.g. wind), actual material properties, self-weight, age of the structure, etc. As a user, you understand that such variables can strongly alter the results of Truss Pal from reality and should be considered in your design and calculations.

There are many possible combinations of supports, fixities, loads, members, materials, sections, etc. This makes it impossible to test and ensure accuracy in all possible scenarios. As a customer, you understand that Truss Pal bases drawing results on information provided by you and the location of the project; however, the risk of deviated results due to differences in software is still possible. Truss Pal results are not to be used for design purposes unless signed off by a professional and competent structural engineer who shall bear full responsibility for the design. Truss Pal offers no warranties or guarantees.

You, at your sole expense, will defend, indemnify, and hold Truss Pal harmless from and with respect to losses or damages (including reasonable attorneys’ fees and costs) incurred in connection with, any suit or proceeding brought by a third party against Truss Pal insofar as such suit or proceeding shall be based upon (i) any claim arising out of or relating to your use of the Product or Services. You will pay any damages and costs assessed against Truss Pal (or paid or payable by Truss Pal pursuant to a settlement agreement) in connection with such a suit or proceeding.
